Summary of Decision

The Hellenic Competition Commission in plenary session decided by majority that FOCUS and MRB violated Article 1 of the Greek Competition Act 3959/2011 by colluding during a tendering procedure for the measurement of radio ratings in Attica (vertical agreement for their shared participation in the tendering procedure).

In particular, the companies agreed that in the event that they win the contract for the radio ratings measurement a) they will participate together for an indefinite time period in tendering procedures for the provision of radio ratings measurements in Attica, whilst prohibiting each other to carry out any such relevant job alone or in cooperation with a third party, and b) MRB will not be active in the measurement of radio ratings in the region of Thessaloniki, neither on its own nor together with any other party.

The Commission decided by majority to impose a fine totaling 87,953.30 Euros to the two companies in violation of Article 1 of the Greek Competition Act 3959/2011.
