Clearance decision on the notified concentration, pursuant to Articles 5-10 of Law 3959/2011, concerning the acquisition of sole control by the Alternative Investment Fund “DIORAMA INVESTMENTS II RAIF, S.C.A.”,  managed by the company “DECA INVESTMENTS Alternative Investment Fund Manager Société Anonyme” (DECA), over the company “LEADER INDUSTRIAL AND COMMERCIAL FOOD S.A.” (LEADER), within the meaning of article 5(2)(b) of Law 3959/2011.

Operative part of the Decision

The Hellenic Competition Commission (HCC), in Chamber sitting, unanimously approved, according to Article 8 (3) of Law 3959/2011, the notified concentration under ref. no. 7660/6.10.2023 concerning the acquisition of sole control by the Alternative Investment Fund “DIORAMA INVESTMENTS II RAIF, S.C.A.” (DIORAMA II)  over the company “LEADER INDUSTRIAL AND COMMERCIAL FOOD S.A.” (LEADER) as, albeit falling within the scope of paragraph 1 of Article 6 of Law 3959/2011, it does not raise serious concerns as to its compatibility with competition rules in the individual markets concerned thereby.

According to the Decision, the concentration under consideration is not expected to bring about any changes in the structure of the relevant markets concerned as competition conditions will not change. Therefore, the above transaction will not affect the level of competition or restrict competition in these markets.
