| Summary of Decision | In plenary session the Hellenic Competition Commission, in an open vote, unanimously cleared, pursuant to Article 8(6) of the Greek Competition Act 3959/2011, the concentration for which notice was given on 9/11/2018. Although the concentration falls within the scope of Article 6(1) of the Greek Competition Act 3959/2011, it does not fall within the scope of Article 3 of Greek Law 3592/2007, since paragraph 3 is not satisfied i.e. the contracting companies do not hold 35% of the market share in the television and radio market. Therefore, since the concentration will not give rise to a dominant position, it is unlikely that a concentration of control will be created and that competition will be significantly limited under Article 7(1) of the Greek Competition Act 3959/2011. |
